Terms of Service
1. Acceptance of Terms
By accessing and using the services provided by Anagata IT Solutions (“Anagata”, “we”, “us”, “our”), including our website at anagataitsolutions.in, automation consulting, and self-hosted software deployments, you agree to be bound by these Terms of Service. If you do not agree to these terms, please refrain from using our services.
2. Service Scope
Anagata provides AI Automation as a Service (AiaaS), specializing in:
- Workflow automation orchestration using n8n and Docker.
- Custom AI Agent development and deployment.
- Self-hosted infrastructure setup for MSMEs.
- Sales and WhatsApp automation consulting.
All specific deliverables, timelines, and costs will be governed by a separate Service Level Agreement (SLA) or Statement of Work (SOW) signed by both parties.
3. Client Responsibilities
To ensure successful project execution, the Client agrees to:
- Provide timely access to necessary accounts, APIs, and documentation.
- Ensure all data provided for automation processes complies with local privacy laws.
- Maintain the security of credentials provided for self-hosted deployments.
Self-Hosted Infrastructure Disclaimer
When Anagata deploys solutions on Client-owned infrastructure (e.g., Docker containers on HETZNER or AWS), the Client assumes full responsibility for server maintenance, security patches, and backup management unless a managed maintenance plan is explicitly purchased.
4. Intellectual Property
Upon final payment, the Client owns the configuration of the specific workflows developed for them. However, Anagata retains ownership of pre-existing proprietary “Blueprints,” scripts, and frameworks used to build the automation. Anagata grants the Client a non-exclusive, perpetual license to use these components for internal business operations.
5. Limitation of Liability
Anagata IT Solutions shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use of automated systems, including but not limited to loss of revenue from API outages of third-party platforms (like Meta, OpenAI, or Google).
6. Governing Law
These terms are governed by the laws of India. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Himachal Pradesh, India.
